The Employment Equality (Age) Regulations 2006 – Guide 2: Exemptions

The exemptions under the Age Regulations are more extensive than in other discrimination legislation. The Age Regulations allow justification of direct as well as indirect discrimination. Some of the exemptions relate to the business objectives of employers and others relate to public policies which have an impact on employers, employees and training activity. This TAEN guide groups them together to give an overall picture of the exemptions.

It covers justifiable and legitimate employer actions; the national minimum wage; social security systems; and statutory exemptions for existing UK laws. It also advises which TAEN guides provide information on the exemptions relating to genuine occupational requirements; length of service pay and benefits; Government funding of adult training; redundancy pay; retirement procedures and fixed retirement ages; occupational pensions; and national security and the armed forces.
